What the rule actually is, market by market.

Most “invest in Africa” material stops at the opportunity. The question that decides whether you can act on it is narrower: can a foreigner hold the asset, in what vehicle, in what currency — and does the purchase carry a right to stay. Five markets, five different answers.

Can a foreigner hold it
Built residential and commercial property, yes — subject to administrative validation before the transaction completes. Agricultural land is closed to foreign buyers.
Vehicle & investment regime
A local company registered through AAPI, the single window. Law 22-18 of 2022 ended the blanket 51/49 cap outside strategic sectors, so up to 100% foreign holding is now possible in building materials, light manufacturing and most industry.
Currency & repatriation
The dinar is not freely convertible. The statutory transfer guarantee attaches where the foreign-financed share is at least 25% of total investment cost — structure the funding to clear that line.
Does it carry residency
No property-linked residence route. Residence follows the investment vehicle and the work permit, not the deed.

The diaspora door

African households abroad already move more money onto the continent than donors do, and in most years more than foreign direct investment. Almost none of it converts into titled, income-producing property, because the product does not exist: a purchase you can complete, finance and verify from Paris, Montreal or Dubai. That gap is the opportunity — and African investors are structurally best placed to close it.

Double-taxation treaties behind a Mauritian vehicle

The foreign door

Capital without a passport on the continent enters through structure: a treaty-network holding company, a local operating joint venture with a licensed partner, or co-lending alongside a development finance institution that has already done the country work. You are buying exposure without the licensing burden, and paying for it in governance rather than in yield.
